1. Acceptance of Terms

By accessing and using the Mold Free Mom website (the "Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use this Service.

2. Service Description

Mold Free Mom provides life coaching services, assessments, AI coaching assistance, and digital content for mothers. Our services include but are not limited to personality assessments, coaching sessions, digital courses, and community support. All content and services provided are for informational and educational purposes only and are not a substitute for professional mental health services.

3. User Accounts and Conduct

You are responsible for safeguarding the password and all activities that occur under your account. You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Service. You may not attempt to gain unauthorized access to any portion of the Service or any other systems or networks connected to the Service.

Community Guidelines

Our members' community is a moderated space for peer support. Content you post there is visible to other logged-in members. When taking part, you agree that you will not:

Harass, threaten, bully, or demean other members, or post hateful, discriminatory, or abusive content
Post spam, advertising, solicitations, or promotional content without our permission
Share another person's private, personal, or contact information without their consent
Impersonate any person or misrepresent your affiliation with any person or organization
Post content you do not have the right to share, or that infringes the intellectual property or privacy rights of others
Present information as professional medical advice or diagnosis. Community discussions are peer support and personal experience only, and are not a substitute for advice from a qualified healthcare professional

Community discussions reflect the personal experiences and opinions of individual members and do not represent the views of Mold Free Mom. We may, at our discretion and without prior notice, moderate, edit, or remove any content, and suspend or terminate the account of any member who violates these guidelines.

4. Payment Terms and Refund Policy

Memberships:

No refunds will be provided for membership subscriptions after 7 days from the initial purchase date. Cancellations can be made at any time, but no prorated refunds will be issued.

Quiz Results:

All sales of quiz results and personality assessments are final. No refunds will be provided for digital quiz content once delivered.

Coaching Sessions:

Refunds for coaching sessions will only be provided if requested within 72 hours of purchase AND no coaching sessions have been used or attended. Once a coaching session has been utilized, no refunds will be provided.

5. Intellectual Property

The Service and its original content, features, and functionality are owned by Mold Free Mom and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service without prior written consent.

Program Materials License

"Program Materials" means all content made available to you through our paid programs, courses, coaching services, and member areas, including written guides, checklists, worksheets, meal plans, supplement and treatment roadmaps, videos, session recordings, assessments and their scoring methods, the structure, sequence, and naming of our recovery phases, coaching frameworks and curricula, community resources, and content delivered through our AI coaching tools.

When you purchase a program, course, or coaching service, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Program Materials for your own personal, non-commercial use. All Program Materials remain the exclusive property of Mold Free Mom. Your purchase is a license to use the materials, not a transfer of ownership.

You agree that you will not, and will not permit or assist any third party to:

Share, resell, sublicense, publish, or distribute Program Materials, or share your account access with others
Copy, adapt, translate, or otherwise use Program Materials to create, market, or sell any product, program, course, coaching service, or content that competes with or substitutes for our offerings
Use Program Materials to provide coaching, consulting, or educational services to third parties, whether paid or unpaid
Scrape, crawl, systematically download, or otherwise extract Program Materials or Service content, or use any of it to train, fine-tune, or ground artificial intelligence or machine learning systems
Remove, alter, or obscure any copyright, trademark, or other proprietary notices contained in the Program Materials

This license ends automatically if you violate these Terms, if your purchase is refunded, or if your account is terminated. The restrictions in this section survive the end of the license. You acknowledge that unauthorized use of Program Materials would cause harm to Mold Free Mom for which monetary damages may be an inadequate remedy, and that we are entitled to seek injunctive relief in addition to any other remedies available at law, including termination of your account and legal action.

6. User Content and Data

You retain rights to any content you submit, post, or display on or through the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content in any and all media or distribution methods for the purpose of providing our services. If you post content in our members' community, you understand and agree that it will be visible to other logged-in members alongside your community display name and profile photo.

7. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices regarding the collection and use of your personal information.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any representations or warranties, express or implied. Mold Free Mom makes no representations or warranties in relation to this Service or the information and materials provided on this Service. We do not warrant that the Service will be uninterrupted, secure, or error-free.

9. Limitation of Liability

In no event will Mold Free Mom, its affiliates, agents, directors, employees, suppliers, or licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, this Service.

10. Indemnification

You agree to defend, indemnify, and hold harmless Mold Free Mom and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).

11. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will cease immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13. Changes to Terms

Mold Free Mom reserves the right, at its sole discretion, to modify or replace any part of this Agreement at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. It is your responsibility to check this Agreement periodically for changes.
